Haley Van Erem, who spent nearly a decade in the DOJ’s civil rights Division, has filed a whistleblower complaint alleging that the investigations were politically motivated and deviated from standard procedures.

The complaint, filed with the House Judiciary Committee, details irregularities in the investigations into Brown, Columbia, and Harvard universities. Van Erem alleges that senior officials at the DOJ and HHS departed from longstanding investigative practices designed to ensure due process, accuracy, and legal compliance.

Allegations of Predetermined Outcomes

The whistleblower complaint suggests that the enforcement outcomes of these investigations were predetermined before the relevant evidence was collected and evaluated. Van Erem claims that some investigations were opened without a sufficient factual predicate and that concerns raised by career attorneys were often disregarded.

In the case of Brown University, witness interviews and document reviews concluded that there was no Title VI violation. However, some in DOJ leadership still sought a settlement violation. Similarly, the investigation into Columbia University was conducted on an accelerated timeline based on media reports, and the investigation into Harvard University involved extraordinary funding freezes and sweeping proposed settlement terms before any completed investigation had established Title VI violations.

Political Motivations and Procedural Irregularities

Van Erem’s complaint alleges that the investigations were part of a politically mandated effort to extract money from schools through settlement demands and funding freezes under the pretext of rooting out antisemitism. The complaint also suggests that the investigations were designed to harass and intimidate rather than protect anyone from discrimination.

Rep. Jamie Raskin, the top Democrat on the House Judiciary Committee, has publicly criticized the actions of the DOJ and HHS officials, alleging that the investigations were structured deliberately to harass and intimidate rather than protect anyone from discrimination. Raskin has described the whistleblower’s allegations as credible and has called for oversight and investigation into the matter.

The Response from the Justice Department

The Justice Department has stood behind the integrity of its investigations, stating that Van Erem did not work on university investigations while at the DOJ. However, the whistleblower complaint has raised serious questions about the transparency and fairness of these investigations.

The allegations have sparked a broader public discussion about the administration’s efforts to confront allegations of antisemitism at colleges.
